11. Public Access

Loitering and Non-Solicitation

Although many areas within the Master Condominium are areas of free access, such areas are also the private property of the Master Condominium and Owners. These areas are intended for the use and enjoyment of the Owners, Occupants, and their invitees; however, all west-east walkways from the Paseo to the beach are available to provide public access to the beach.

To strike a balance between maintaining an open and welcoming community and preserving the privacy and security of Owners, Occupants, and their invitees, the Managing Agent, through Area Supervision personnel, has the power to remove or ban from the Common Areas any person(s) who are found roaming or loitering with no legitimate purpose.

The Managing Agent or Area Supervision personnel may contact local police authorities if they have reasonable cause to believe that a crime is being or has been committed.

Solicitation and sales are not allowed door-to-door or within Common Areas, unless permitted by advance written approval of the Managing Agent. The Managing Agent, through Area Supervision personnel, has the power to remove or ban from the Common Areas any person(s) who are found conducting door-to-door solicitation or other solicitation or sales not approved by the Managing Agent.
